The Justice System

The purpose of justice and law is to protect innocent, well meaning people from those among us who would take unfair advantage of them, use them for their own ends or commit mayhem upon them. Given that this IS the reason for laws and punishment under the law, why is it that some evidence is suppressed in a trial where the purpose of the trial is to determine the truth of allegations against the defendant? The truth is being sacrificed for the sake of technicalities.

One obvious reason for this is to keep innocent people from being "railroaded" by the cops or prosecutors, however, there should be a way to validate illegally obtained evidence to make it admissible; the evidence does exist, after all, whether it was found from an illegal search or accidentally obtained while searching for something else. If the truth is known, but can't be used, how can that serve justice?

Suppose now that a person has been convicted and now must be punished. Isn't the purpose of punishment to reform? For some people, the fact that they were caught has already reformed them while for others, reform seems impossible for us to accomplish. For that reason we have enacted "three strikes" laws to keep incorrigible criminals off the streets. Should we not create other ways to determine if a criminal has been reformed or not, and if not, shouldn't we keep the person incarcerated forever? On the other hand, if true reform has been achieved, should not the person be released as soon as possible to contribute to society rather than be a burden?

Too many known "bad guys" are free to follow their criminal ways while others who will never commit any crime again are being supported in prison at our expense. Can we not devise a way to differentiate these people and achieve true justice?

Your sentence, "Too many known "bad guys" are free to follow their criminal ways ..." So true! Our home was burglarized by a man who was out of prison on a day pass. Although he was apprehended, he took money that was never reimbursed. He was really looking for guns. Now, I ask you .. Can you imagine what he was going to do with the guns? Thank goodness he found none. It was the first time our home has ever been broken into and hopefully, the last. I believe there must be a way for the authorities to assess more reliably the rehabilitation of a criminal.

Your intel made me think about this problem again - in the right hands, maybe someone can do something about this situation.
